თავისუფლება მიხეილ სააკაშვილს- მიმართვა სალომე ზურაბიშვილს

მის აღმეტებულებას,

საქართველოს პრეზიდენტს,

სალომე ზურაბიშვილს,

ქალბატონო პრეზიდენტო,

საქართველოს მოქალაქეები მოგმართავთ თხოვნით, რომ გამოიყენოთ თქვენი ექსკლუზიური უფლებამოსილება, შეწყალების უფლება, და პოლიტიკური პატიმრობისაგან გაანთავისუფლოთსაქართველოს მესამე პრეზიდენტი მიხეილ სააკაშვილი.  

 მიხეილ სააკაშვილის პატიმრობიდან განთავისუფლება პირდაპირ არის დაკავშირებული ჩვენი ქვეყნის ინტერესებთან. თქვენი გადაწყვეტილება იქნება თქვენი პასუხი ევროკომისიის მოთხოვნებზე, რომელიც საქართველოს წარედგინა, როგორც წინაპირობა ევროკავშირში გაწევრიანებისათვის მოლაპარაკებების დასწყებად.

  მიგვაჩნია, რომ:    

მიხეილ სააკაშვილი დღეს არის პოლიტიკური პატიმარი და საქართველოში მას არ აქვს უფლება ისარგებლოს თავისუფალი სასამართლოთი. ჩვენს მოსაზრებას საქართველოს სასამართლოების მხრიდან შერჩევითი მართლმსაჯულების განხორციელების პრაქტიკა და ჩვენი მთავარი სტრატეგიული პარტნიორების  (ევროკავშირის წევრი ქვეყნების და ამერიკის შეერთებული შტატების) მიერ მიღებული გადაწყვეტილებები გვიმყარებს.  

სულ ცოტა ხნის წინ, ამერიკის მთავრობამ სანქციები გამოიყენა საქართველოს უზენაესი სასამართლოს 4 მოსამართლის წინააღმდეგ, რომლებიც სასამართლოში კორუფციასა და კლანურ მმართველობაში ამხილა.  

პრეზიდენტი სააკაშვილის პოლიტიკური დევნის შეფასებისას, ასევე მნიშვნელოვანია, რომ გაითვალისწინოთ საქართველოს ყოფილი მთავარი პროკურორის, რუსეთის მოქალაქის, ოთარ ფარცხალაძის გავლენა  საქართველოს მთავრობაზე  და მისი აშშ სახელმწიფო დეპარტამენტის მიერ გახმოვანებული კავშირი რუსეთის სპეცსამსახურებთან. სახელმწიფო მდივნის მიერ გავრცელებულ ოფიციალურ განცხადებაში ვკითხულობთ, “სავარაუდოდ FSB ფარცხალაძეს იყენებდა ქართულ საზოგადოებასა და პოლიტიკაზე რუსეთის სასარგებლო გავლენების მოხდენაში“. ამერიკის მთავრობისაგან ასეთი საგანგაშო ინფორმაციის მიღების მიუხედავად „ქართული ოცნება“ განაგრძობს ოთარ ფარცხალაძის დაცვას რაც სარწმუნოს ხდის ინფორმაციას, რომ ფარცხალაძეს დღემდე აქვს გავლენა  ქართულ სასამართლოზე და ზოგადად მთავრობაზე, განსაკუთრებით სპეცსამსახურებსა და პროკურატურაზე. ასეთ შემთხვევაში შეუძლებლია რომ მიხეილ სააკაშვილის მიმართ განხორციელდეს სამართლიანი მართლმსაჯულება.  

მიხეილ სააკაშვილი არის ვლადიმერ პუტინის პირადი პატიმარი და მის მიმართ შურისძიება ხორცილედება საქართველოს პრო-რუსული მთავრობის ხელით. სააკაშვილი პუტინის მიერ ისჯება იმისათვის, რომ მან 9 წლის განმავლობაში საქართველო გაანთავისუფლა რუსეთის გავლენებისაგან და საქართველოს საგარეო და უსაფრთხოების პოლიტიკა მაქსიმალურად დაუახლოვა ევროკავშირის გენერეალურ პოზიციას. სააკაშვილმა ქართველი ხალხის თვალში მოახდინა ევროკავშირის და მისი იდეოლოგიის პოპულარიზაცია, რისი ობიექტური შედეგიცაა ქართველი ხალხის დღევანდელი მისწრაფება გახდეს ევროკავშირის წევრი.  

სააკაშვილის განთავისუფლებით თქვენ შეძლებთ პოლარიზაციის შემცირებას საქართველოში, რაც ასევე არის ქართველი ხალხის მნიშვნელოვანი ნაწილის და ჩვენი ევროპელი მეგობრების მოთხოვნა.  

პრეზიდენტი სააკაშვილის პოლიტიკური პატიმრობიდან განთავისუფლებით, თქვენ კიდევ ერთხელ აჩვენებთ თქვენი ევროპული ღირებულებებისადმი ერთგულებას და ხელს შეუწყობთ მომავალი წლის საპარლამენტო არჩევნებისათვის კონკურენტუნარიანი გარემოს შექმნას. მხოლოდ ძლიერი ოპოზიცია შეძლებს, არ მისცეს საქართველოს პრო-რუსულ მთავრობას არჩევნების გაყალბების საშუალება და იყოს იმის გარანტი, რომ ჩატარდება თავისუფალი და სამართლიანი არჩევნები. ამ გზით არჩეული მთავრობა შეძლებს ჩვენი ქვეყნის ევროკავშირში ინტეგრაციას. ამ პროცესში აუცილებელია ყველა გამოცდილი, პროდასავლელი პოლიტიკოსის და ბუნებრივი მოკავშირის ჩართულობა და სააკაშვილი სწორედ ასეთ პიროვნებად წარმოგვიდგენია.  

ოლიგარქის  ძალაუფლებისაგან ჩამოშორების გარეშე შეუძლებლად მიგვაჩნია დეოლიგარქიზაციის პროცესი და ხელისუფლების დანაწილების პრინციპის განხორციელება. აქ პირველ რიგში იგულისხმება თავისუფალი სასამართლოს შექმნა, რაც არის საქართველოში ადამიანის უფლებების დაცვის ერთაერთი ურყევი გარანტია.  

ყოველივე ზემოაღნიშნულიდან გამომდინარე კიდევ ერთხელ მოგმართავთ პრეზიდენტი სააკაშვილის პატიმრობისაგან განთავისუფლების მოთხოვნით, რასაც ვადასტურებთ ჩვენი ხელმოწერით.

Madame President,

We, the group of Georgian citizens, appeal to you, Your Excellency, to exercise your exclusive Constitutional right – the prerogative of Presidential pardon, and to release from political imprisonment the Third President of Georgia, Mr. Mikheil Saakashvili.

This act is intricately connected with the national interests of our country. Your decision would be a clear and unequivocal answer to the request from the European Union, which demanded President Saakashvili’s release as a precondition to the opening of the formal negotiations on Georgia’s future membership of the EU.  

We believe, that presently Mikheil Saakashvili is a political prisoner and in Georgia he has no access to free and independent court. Our opinion on this matter, namely the selective nature of the Georgian justice system, is formed and strengthened by the decisions and pronouncements on the subject by our strategic partners – the EU member States as well as the United States of America.  

Not so long ago the Government of the United States sanctioned four judges of the Supreme Court of Georgia for “significant corruption and undermining the public’s faith in Georgia’s judicial system”.

When talking about political persecution of Saakashvili, it is vitally important to bear in mind the influence exerted by the former Attorney General of Georgia, the citizen of Russia, Otar Partskhaladze over the Government of Georgia and his connections with the Russian security services, as revealed by the Department of State. In his statement, the Secretary of State pointed to the fact that “FSB (Russian Federal Security Service) was using Partskhaladze to adversely influence Georgian society and Government, thus benefitting the Russian Federation.” Despite receiving the above alarming information from the Government of the United States, “Georgian Dream” continues to protect Partskhaladze and justify his actions. This is undoubtedly further proof that Partskhaladze retains his influence over the justice system and the Government of Georgia, in general, and over the Attorney General’s office and the security services, in particular. Under the circumstances it is impossible to assume that justice will prevail in case of Saakashvili.  

Mikheil Saakashvili is a personal prisoner of Vladimir Putin, and the revenge against him is delivered by the pro-Russian Georgian Government. Saakashvili is punished for nine years of his presidency; for delivering Georgia from Russian bondage; for closing gap in Foreign and Military Policies of Georgia and that of European Union. Georgian people associate him with the growing popularity of the European Union and it’s ideology, which resulted in country’s relentless movement towards the membership in the EU.   

By freeing Saakashvili you will considerably reduce the political polarization, which basically responds to the desire of the overwhelming majority of Georgians and satisfies the request of our European friends.  

By releasing Saakashvili from prison, you will once again demonstrate your unwavering devotion to the European values, as well as assist in leveling the field for the upcoming parliamentary election. A strong and independent opposition can stand up to the efforts of the pro-Russian ruling power to rigg the election. It can serve as a guarantor of free, fair and truly democratic elections. Any government elected this way will be able to guide the country and people towards the integration into the European institutions. This process should include all experienced politicians and natural allies. And we consider Mr. Saakashvili to be such an individual.  

Without taking the power out of the hands of the oligarch, it will be impossible to launch the process of de-oligarchization, as well as the implementation of the power sharing doctrine. Here we mean the setting up of a free and independent justice system, which eventually will serve as a stalwart defender of human right in the country.  

Proceeding from all the above, we once again appeal to you, Madame President, to free the Third President of Georgia Mr. Mikheil Saakashvili.
